ACVoIP, a division of Valstar Consulting ("ACVoIP", "we", "us", or "our"), is committed to protecting your privacy and personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Voice over Internet Protocol (VoIP) services and related telecommunications services (collectively, the "Services").

This Privacy Policy is incorporated into and forms part of our Terms and Conditions of Service. By using our Services, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy.

  • Usage Data: Call logs (including call duration, timestamps, and destination numbers), service usage patterns, and feature utilization
  • Network Information: Internet service provider, connection type, and network performance metrics

1.3 Call Detail Records (CDRs)

We maintain detailed call records for billing, service quality monitoring, fraud prevention, and regulatory compliance purposes. CDRs include call origination and termination numbers, call duration, timestamps, and call quality metrics.

2. How We Use Your Information

We use the information we collect for the following purposes:

  • Service Delivery: To provide, operate, and maintain our Services, including call routing, voicemail, fax services, and account management
  • Billing and Payment Processing: To process payments, generate invoices, and manage accounts receivable
  • Customer Support: To respond to inquiries, troubleshoot issues, and provide technical assistance
  • Service Improvement: To analyze usage patterns, optimize network performance, and develop new features and services

  • Communications: To send service-related notices, updates, security alerts, and administrative messages (you may opt out of promotional communications at any time)
  • Emergency Services: To provide Enhanced 911 (E911) service and transmit your registered address to emergency responders

3. Information Sharing and Disclosure

We do not sell, rent, or trade your personal information to third parties. We may share your information in the following limited circumstances:

3.1 Service Providers

We engage trusted third-party service providers to perform functions on our behalf, including payment processing, data hosting, customer support, and analytics. These providers are contractually obligated to use your information only as directed by ACVoIP and in compliance with applicable privacy laws.

3.2 Telecommunications Carriers

To complete calls and provide Services, we must share certain information (such as calling and called numbers) with telecommunications carriers and interconnection partners. This sharing is necessary for the technical operation of VoIP services.

3.3 Legal Requirements

We may disclose your information if required to do so by law or in response to valid legal process, including court orders, subpoenas, or lawful intercept warrants issued under the Criminal Code of Canada or other applicable legislation.

3.4 Business Transfers

In connection with a merger, acquisition, sale of assets, or bankruptcy, your information may be transferred to a successor entity. We will notify you of any such change and any choices you may have regarding your information.

3.5 With Your Consent

We may share your information with third parties when you provide explicit consent or direct us to do so.

4. Data Security

We implement industry-standard administrative, technical, and physical security measures to protect your information from unauthorized access, disclosure, alteration, and destruction. These measures include:

  • Encryption of data in transit using TLS/SSL protocols
  • Encryption of sensitive data at rest
  • Secure data centers with physical access controls

  • Account Information: Retained for the duration of your account plus seven (7) years after account closure for tax and legal compliance
  • Call Detail Records: Retained for twenty-four (24) months for billing disputes and service quality analysis, then anonymized or deleted
  • Payment Information: Retained for seven (7) years after account closure as required by tax legislation
  • Support Communications: Retained for thirty-six (36) months after resolution

Upon account termination, we will delete or anonymize your personal information within thirty (30) days, except where retention is required by law or for legitimate business purposes (e.g., fraud prevention, dispute resolution).

6. Your Rights and Choices

Under PIPEDA and applicable privacy laws, you have the following rights regarding your personal information:

6.1 Access

You have the right to request access to the personal information we hold about you. We will provide this information within thirty (30) days of receiving your written request, subject to limited exceptions permitted by law.

6.2 Correction

You have the right to request correction of inaccurate or incomplete personal information. You may update certain information directly through your online account or by contacting customer support.

6.3 Deletion

You may request deletion of your personal information, subject to legal and contractual restrictions. Note that certain information must be retained for legal compliance (e.g., tax records, call detail records for regulatory purposes).

6.4 Withdrawal of Consent

You may withdraw consent for certain uses of your information (e.g., marketing communications) at any time. However, withdrawal of consent may limit our ability to provide Services.

6.5 Complaints

If you have concerns about our privacy practices, you may file a complaint with the Office of the Privacy Commissioner of Canada (www.priv.gc.ca) or the applicable provincial privacy commissioner.
